(hereinafter referred to as “Soulhouse”)
1. Scope and General Provisions
1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all business relationships between Soulhouse and customers (hereinafter “Customer”) in the version valid at the time the Customer places the order or commissions the service or delivery.
1.2 Deviating, conflicting, or supplementary general terms and conditions of the Customer shall not be recognized unless Soulhouse expressly agrees to their validity. This requirement for consent applies in all cases, for example even if Soulhouse performs the service or delivery without reservation in the knowledge of the Customer’s terms and conditions.
1.3 The Customer may be either a consumer or an entrepreneur. A Customer is a consumer insofar as the purpose of the ordered services and deliveries cannot be predominantly attributed to their commercial or self-employed professional activity (hereinafter “Consumer”). In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or self-employed professional activity (hereinafter “Entrepreneur”). Natural persons can only be Customers if they have reached the age of 18.
1.4 Legally relevant declarations and notifications to be made by the Customer to Soulhouse after conclusion of the contract (e.g. setting deadlines, notices of defects, declarations of withdrawal, termination, or reduction) must be made in text form in order to be effective, unless expressly stated otherwise.
2. Contractual Services
2.1 Contractual services of Soulhouse may include, in particular, the services pursuant to the following sections 2.2 – 2.6.
2.2 Stationary massages
Stationary massages are massage services provided by Soulhouse in one of its locations (hereinafter “Soulhouse Boutique”) on the basis of a corresponding contractual agreement.
2.3 Mobile massages
2.3.1 Mobile massages are massage services that are not provided in a Soulhouse Boutique, but in premises provided by the Customer, e.g. at the Customer’s premises, events, or trade fairs (hereinafter “Customer premises”).
2.3.2 For mobile massages, additional costs may be incurred for the travel to and from the Customer premises by the Soulhouse employee (hereinafter “at home costs”). These costs will be indicated during the booking process where applicable.
2.4 Massage vouchers
Massage vouchers are vouchers issued by Soulhouse for stationary or mobile massage services, which the Customer can purchase for a fee via the Soulhouse online shop or in Soulhouse Boutiques.
2.5 Merchandising products
Merchandising products are products offered by Soulhouse that can be purchased for a fee via the online shop or in Soulhouse Boutiques.
2.6 Booking by pregnant customers
Pregnant customers may exclusively book the designated pregnancy massage. Booking is only possible from the 2nd trimester (from the 13th week of pregnancy). Other types of massages are excluded during pregnancy for safety reasons, even if no medical contraindications exist.
3. Online Shop and Registration
3.1 Soulhouse operates an online platform accessible via a website (hereinafter “Website”) and via a mobile application for Apple iOS and Google Android (hereinafter “mobile app”) (together “Online Platform”). Via this platform, customers can conclude contracts for stationary and mobile massages and purchase vouchers and merchandising products (hereinafter “Online Shop”).
3.2 Contracts for services are concluded exclusively with Soulhouse.
3.3 Customers may conclude contracts either as registered users or as guests. Registration is free of charge.
3.4 Registration is carried out via the Online Platform. By clicking “Register,” the Customer submits their application. Soulhouse accepts the registration by sending a confirmation email requesting verification of the email address (conclusion of contract). Registration is completed upon verification. Only persons aged 18 or older may register. There is no entitlement to registration. Only one registration per Customer is permitted.
3.5 Customers may terminate their registration at any time. Soulhouse may terminate registration with two weeks’ notice. The right to extraordinary termination remains unaffected. Termination must be in text form. Existing service contracts remain unaffected.
4. Special Provisions for Massage Services
4.1 Conclusion of contract
4.1.1 Online Shop
Offers are binding. By submitting the booking, the Customer accepts the offer (contract conclusion). A confirmation email is sent immediately.
4.1.2 On-site
Contracts may also be concluded in Soulhouse Boutiques.
4.2 Prices and travel costs
4.2.1 All prices include statutory VAT.
4.2.2 Travel costs for mobile services are shown during booking and must be borne by the Customer.
4.3 Payment and due date
4.3.1 Various payment methods are available (credit card, Klarna, PayPal). Soulhouse may restrict methods.
4.3.2 Payment is due immediately upon contract conclusion.
4.4 Cancellation
4.4.1 Bookings may be cancelled up to 24 hours before the appointment. Short-notice cancellations are excluded.
4.4.2 Cancellation via portal, email, or phone. Customer receives a voucher; refunds are excluded. Soulhouse may reschedule appointments for organizational reasons.
Right of Withdrawal
4.5.1
Consumers have a right of withdrawal for online bookings:
Withdrawal instruction
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of contract conclusion.
To exercise the right, you must inform us (Soulhouse GmbH…) by a clear declaration.
Consequences of withdrawal
Payments will be refunded within 14 days using the same payment method. If services began, proportional payment is required.

4.6 Discounts and promotions
Conditions are communicated separately. Codes are non-transferable and cannot be paid out. No combination allowed.
4.7 Liability for mobile services
Customer must protect premises. Soulhouse is not liable for damages unless caused by gross negligence or intent.
5. Vouchers and Merchandise
5.1 Contract conclusion
Same structure as section 4.
5.2 Prices and shipping
VAT included; shipping costs apply.
5.3 Payment
Section 4.3 applies.
5.4 Retention of title
Goods remain property of Soulhouse until full payment.
5.5 Vouchers
Valid for 2 years. No cash payout. Remaining balances expire.
5.6 Warranty
Statutory warranty applies.
5.7 Delivery
Standard delivery: 5 days unless otherwise stated. Delivery only within Germany.
5.8 Right of withdrawal (goods)
Same structure as above, adapted for goods including return obligations and cost allocation.
6. Liability
6.1 Full liability for intent and gross negligence.
6.2 Limited liability for essential contractual obligations.
6.3 Exceptions: life, body, health, product liability.
6.4 Applies to employees and agents.
6.5 Health-related risks
Services are for wellbeing only, not medical treatment.
Customer must disclose conditions.
No liability for missing information.
Booking implies acceptance of risk.
7. Health and personal responsibility
Services are not medical treatment.
Medical advice recommended in certain cases.
Pregnancy massages only from week 13.
Customer confirms no contraindications.
Use at own responsibility.
8. Loyalty points
Points only for registered users.
Non-transferable, no cash value.
Expire after 24 months.
May be revoked upon contract reversal.
System may be discontinued at any time.
9. Data protection
Reference is made to the separate privacy policy.
